Terms of Service

The agreement governing your use of PROVISUM.

These Terms of Service ("Terms") govern your access to and use of PROVISUM (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or 21+ where required by your jurisdiction), legally able to form a binding contract, and not barred from using the Service or the underlying venues under any applicable law. The Service is informational only and is not offered where prohibited.

2. The Service; not advice

The Service provides a real-time scanner and analytics over publicly available prediction-market data. It is not financial, investment, tax or legal advice, a managed account, a broker or exchange, and it does not execute trades or hold funds. See the Disclaimer.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information, keep it current, and maintain one account per person. Notify us promptly of any unauthorized use.

4. Subscriptions, billing & taxes

The Service offers a free tier and a paid "Pro" subscription. Paid plans are billed in advance on a recurring monthly basis through our payment processor (Stripe) and renew automatically until cancelled. Promotional pricing (such as a discounted first month) applies as described at checkout; after any promotional period the standard rate applies. You may cancel at any time from your account page and retain access through the end of the paid period; fees already paid are non-refundable except where required by law. Prices are exclusive of applicable taxes (e.g. VAT/sales tax), which may be added at checkout. We may change prices or plan features on prospective notice.

5. Acceptable use

You agree not to: scrape, resell, redistribute, or create derivative datasets from PROVISUM data; share, resell or sublicense your access; circumvent access tiers, rate limits, or security; probe, overload, or disrupt the Service; use automated means beyond the provided API's documented limits; or use the Service unlawfully or to facilitate anything illegal in your jurisdiction.

6. Intellectual property

The Service, its software, design, and compiled analytics are owned by PROVISUM and its licensors and are protected by law. Underlying market data belongs to the respective venues. We grant you a limited, revocable, non-transferable licence to use the Service for your own personal, non-commercial due diligence.

7. Disclaimers & limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. To the maximum extent permitted by law, PROVISUM and its operators shall not be liable for any trading or investment losses, or for any indirect, incidental, special, consequential, or exemplary damages, arising from your use of or inability to use the Service. Our total aggregate liability for any claim shall not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless PROVISUM and its operators from any claim or demand arising out of your use of the Service, your trading activity, or your breach of these Terms.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Sections that by their nature should survive (IP, disclaimers, liability, indemnity, governing law) survive termination.

10. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which the operating entity is established, without regard to conflict-of-laws rules. To the extent permitted by law, disputes shall be resolved by binding individual arbitration and not in a class action; you retain any non-waivable rights under mandatory local consumer law. (The operating entity and governing jurisdiction are to be confirmed by the operator before public launch.)

11. Changes

We may update these Terms; material changes take effect on posting with an updated date, and your continued use constitutes acceptance. If you disagree, stop using the Service.

12. Miscellaneous

If any provision is unenforceable, the rest remains in effect. These Terms, the Privacy Policy and the Disclaimer are the entire agreement between you and us regarding the Service.
